Courtroom Etiquette

Talking to a judge in court is serious business, since your freedom could well be in his or her hands. If you know a bit about courtroom etiquette, however, you can take steps to show the judge that you are a respectable, sensible person.

Being rude to a judge is never a good idea, and most people are aware that they should look presentable in court. This means no shorts or sandals, and never going barefoot or without a shirt. Some other things to bear in mind:

  • Unless your lawyer tells you otherwise, always arrive at court exactly when you are told to.
  • Sit quietly and listen for your case to be called. Sometimes this can take quite a while.
  • Never bring any food or drink into court. And, obviously, never go to court drunk.
  • Turn your phone off and leave any young children with someone else if at all possible. If your child causes a disruption, you may be asked to leave.

Remember that a judge has the ability to determine your charges and sentence, and in many cases can determine whether or not to charge you with a felony. By knowing courtroom etiquette, you may be able to reduce the chances that you will have a felony conviction. Remember: felonies cannot be expunged from your record.
