What is a Misdemeanor?

Anyone who's ever watched a cop show on TV is probably at least somewhat familiar with misdemeanors and felonies and the general differences between the two. But if you haven't, or you still aren't quite sure of the difference, you should learn. It's the duty of every American to have at least a basic understanding of the criminal code, in case you or someone you love is ever charged with a crime.

Many misdemeanors can be expunged from your record. To learn if your particular crime qualifies for expungement, contact Rhode Island expungement lawyer James Powderly by calling 401-662-9006.

Characteristics of Misdemeanors

A misdemeanor is a term that defines a crime that is less severe than a felony. Generally speaking, misdemeanors are crimes in which the punishment is less than a year in prison, although many misdemeanors only involve a monetary fine. It is very unlikely that a first-time misdemeanor conviction will involve any jail time at all, and many first-time misdemeanor convictions are able to be expunged – that is, removed from the criminal record.

Some of the most common misdemeanor offenses include:

  • Petty theft, which is theft of items valued under $400. Theft of valuables over $400 becomes grand theft, a felony charge.
  • Prostitution
  • Disorderly conduct
  • Simple assault, which is differentiated from other types of assault based on severity and intent
  • Public intoxication
  • DUI
  • Drug possession
  • Trespassing
  • Vandalism

If you are convicted of a misdemeanor, it is likely that you will have to perform community service, be put on probation, and/or serve part-time imprisonment.
