Requirements for Expungement

In Rhode Island, arrests and/or convictions for most crimes are eligible for expungement. However, only first offenders may apply to have their records expunged. In order to qualify as a first offender, a person must have no prior convictions or probations on their record (except for the offense which they are having expunged) and must not have any other charges pending against them.

Furthermore, Rhode Island law states that crimes of violence may not be expunged.

If you meet the above requirements for expungement, you must then wait until a certain amount of time has passed after the completion of your sentence, whether that sentence involves probation or jail time.
